Product Liability refers to Defective and Dangerous Products. Every year in the U.S. thousands of people suffer serious personal injury or wrongful death as a result of using a defective and dangerous product. A lawsuit filed to recover damages as a result of using a defective and dangerous product is commonly referred to as a Product Liability lawsuit.

Product Liability refers to a manufacturer or seller being held liable for placing a defective or dangerous product into the hands of consumers. Responsibility for a product defect that causes personal injury or wrongful death can apply to all sellers of the product in the distribution chain. This would include the product manufacturer, a manufacturer of component parts, the wholesaler or the retail store that sold the product.

Generally, a product can be defective or dangerous in one of three situations. First, there could be a manufacturing defect with the product which resulted in it being dangerous. Second, there might be a design flaw with the product that is inherently dangerous that is not guarded against or warned. Lastly, there sometimes is a marketing defect in which a dangerous condition exists and is known about but the consumer is not warned against the dangerous condition. Any one or all of these conditions could lead to serious personal injury or wrongful death.

AUTO ACCIDENTS- PRODUCT LIABILITY LAWSUIT:

Often the injuries in the auto wreck can be due to a product defect, whether a design defect or a manufacturing defect of the vehicle. In the cases in which the plaintiff has severe injuries with damages in excess of the insurance limits, then additional avenues of recovery must be investigated.
